Proper selection by purchaser of the Products for sale by Schaeffler is essential to minimize the risk of any seal, bearing or other Product failure. Such failures can result in property damage or severe personal injury to operators of machinery, vehicles or to others. You must carefully evaluate the particular application on or into which you intend to install the Products. Products require installation by an experienced professional mechanic or qualified maintenance professional. This warranty does not cover failure or malfunctions resulting from (i) use for high performance or racing purposes; (ii) accidents or natural disasters; (iii) improper application or installation, including but not limited to failure to follow Schaeffler’s and/or vehicle manufacturer’s recommended installation guidelines; (iv) modification; (v) alteration; (vi) improper servicing; (vii) tampering; (viii); normal wear and tear; or (ix) negligence, misuse, or abuse, including, but not limited to, engine operation without adequate lubricant or coolant, over or under-fueling, over-speeding, lack of proper maintenance to cooling, lubrication or air intake systems, improper storage, starting, warm-up, run-in or shutdown procedures or the continued operation of an engine after the first sign of a malfunction. This warranty is extended only to the owner of the vehicle on which the Product is installed, for as long as that person owns the vehicle (“Owner”) and is not transferable. Owner is responsible for proper operation and maintenance of the vehicle in accordance with the vehicle manufacturer’s published operation and maintenance manuals. It shall be the obligation of the Owner to provide to Schaeffler satisfactory evidence of compliance with the vehicle manufacturer’s published operation and maintenance manuals.
Schaeffler reserves the right to inspect any Products in question and to make a judgment on the warranty claim. The existence of a defect shall be determined by Schaeffler in accordance with procedures established by Schaeffler. Product returned for a warranty claim must be returned to the distributor from which it was purchased, accompanied by a completed warranty card and all original components. Submit all pertinent paperwork, including copies of the purchase receipt, repair orders, pictures (if applicable), and all paper relating to the warranty claim. Shipping charges must be prepaid by the purchaser.
THERE ARE NO WARRANTIES OTHER THAN AS SPECIFICALLY REFERENCED IN THIS DOCUMENT, AND SCHAEFFLER DISCLAIMS, WHETHER EXPRESS OR IMPLIED, ANY AND ALL WARRANTIES OF MERCHANTABILIY AND/OR WARRANTIES OF FITNESS FOR USE FOR A PARTICULAR PURPOSE. TO THE FURTHEST EXTENT PERMITTED UNDER APPLICABLE LAW, SCHAEFFLER DISCLAIMS LIABILITY, IN TORT OR CONTRACT, IN NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE, FOR ANY OTHER REMEDY OR DAMAGE, WHETHER DIRECT OR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL WITH RESPECT TO ITS PERFORMANCE HEREUNDER, INCLUDING WITHOUT LIMITATION THE PRODUCTS SOLD OR PROVIDED HEREUNDER BY SCHAEFFLER, AND ITS PROVISION OF ANY RELATED SERVICES.
Some states or provinces do not allow the exclusion or limitation of incidental or consequential damages or certain limitations regarding warranty rights, so the above exclusions or limitations may not apply to you. This limited warranty gives you specific legal rights, and you may have other rights, which vary by state or province.
NO OTHER PERSON IS AUTHORIZED BY SCHAEFFLER TO MODIFY OR ADD TO THIS LIMITED WARRANTY OR ANY FURTHER REPRESENTATION, WARRANTY OR GUARANTEE IN ADDITION TO OR CONTRARY TO THIS LIMITED WARRANTY OR CONTRARY TO THE LIMITATIONS AND DISCLAIMERS PROVIDED HEREIN.
